These Terms of Service ("Terms") govern your access to and use of the Convolyn AI chatbot platform and related services (the "Service") provided by Convolyn ("Convolyn," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Convolyn lets you create, configure, and deploy AI chatbots trained on content you provide, embed them on your website, capture leads, view analytics, and hand off conversations to human agents. Features and availability may change over time.

2. Eligibility and accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter a binding contract.
  • You are responsible for the accuracy of your account information and for keeping your credentials secure.
  • You are responsible for all activity that occurs under your account.

3. Plans, billing, and payments

  • The Service offers free and paid subscription plans. Plan features and limits (such as the number of chatbots and monthly message allowances) are described on our pricing page.
  • Paid plans are billed in advance on a recurring basis through our payment provider (Polar). By subscribing, you authorize recurring charges until you cancel.
  • Usage limits: each plan includes a monthly message allowance shared across your account. If you reach your limit, chatbot responses may be paused until the next cycle or until you upgrade.
  • Cancellation: you may cancel at any time; cancellation takes effect at the end of the current billing period. Unless required by law, payments are non-refundable.
  • We may change pricing or plan features. We will provide reasonable notice of material changes that affect you.

4. Your content and Knowledge

  • You retain ownership of the content, documents, and data you upload ("Your Content").
  • You grant us a limited license to host, process, and use Your Content solely to provide the Service (including sending it to AI providers to generate responses).
  • You are solely responsible for Your Content and represent that you have the rights to use it and that it does not violate any law or third-party right.

5. Acceptable use

You agree not to use the Service to:

  • Violate any law or regulation;
  • Infringe intellectual property or privacy rights;
  • Upload malware or attempt to disrupt, overload, or gain unauthorized access to the Service;
  • Abuse, spam, or attempt to circumvent usage limits, rate limits, or security measures;
  • Create chatbots that generate unlawful, harmful, deceptive, harassing, or abusive content;
  • Collect personal information from Visitors without a lawful basis and appropriate disclosures.

We may suspend or terminate accounts that violate these Terms.

6. Visitors and end-user data

When you deploy a chatbot, you may collect information from your website visitors (including conversation content and leads). You are responsible for:

  • Providing your own privacy notice to your visitors;
  • Obtaining any required consents;
  • Handling visitor data in compliance with applicable laws.

With respect to visitor personal data, you act as the controller and Convolyn acts as your processor, processing such data on your behalf to provide the Service.

7. Third-party services

The Service relies on third-party providers (including hosting, AI, payment, email, and infrastructure providers). We are not responsible for the acts or omissions of third parties, and your use of any third-party integration may be subject to that provider's terms.

8. Intellectual property

The Service, including its software, design, and branding, is owned by Convolyn and protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights. You may not copy, modify, reverse engineer, or create derivative works of the Service.

9. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED RESPONSES MAY BE INACCURATE OR INCOMPLETE, AND YOU ARE RESPONSIBLE FOR REVIEWING THEIR SUITABILITY FOR YOUR USE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONVOLYN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold Convolyn harmless from any claims, damages, or expenses arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if required for legal or security reasons. Upon termination, your right to use the Service ends, and we may delete your data in accordance with our Privacy Policy.

14. Governing law
